ATV permits are only issued to residents of the towns that are served by the Kittery and York Water districts including Kittery, Kittery Point, Eliot, York and Cape Neddick.

The undersigned agrees to the following terms and conditions set forth as a privilege to operate a motorized All Terrain Vehicle (ATV) on certain property of the Kittery and York Water Districts located in the Mt. Agamenticus area in York Maine. The ATV is to be used only on designated logging (tote) roads and trails. Roads and trails that have been closed off to ATV’s will be blocked with boulders or logs and signs will be present. Water related activities are strictly prohibited. No swimming, fishing, boating , ice skating, or ice fishing are allowed on any of the Districts’ public water supply reservoirs, including Boulter Pond, Middle Pond, Folly Pond and Bell Marsh Reservoir (Kittery’s supply) or Chase’s Pond and Welch’s Pond (York’s supply). Foot travel only, within 250’ of the normal high water mark of any of the above listed reservoirs, unless you are on an approved trail. Other prohibited activities include tree cutting, burning of fires of any kind at any time, camping and any other activity that would anyway degrade the land or water supply. There is a “carry in, carry out policy, no littering. This privilege to pass across the property of the Districts with an ATV is non-transferable and revocable at the will of the Districts, and shall expire June30th of each year (unless previously revoked by the Districts). The Districts reserve the right to limit the number of permits issued for any reason. The Districts also reserve the right to close the watershed properties anytime it feels the water quality could be in danger of contamination. The undersigned assumes all risks associated with operating an ATV on the Districts’ properties, with the understanding that operating an ATV on unpaved roads and trails is an inherently dangerous activity, and that the Districts have made no representation that the roads and trails are safe for such use.

I hereby agree to follow these terms and conditions set forth by the Kittery Water District and York Water District and in no way will hold the Districts liable for bodily injury or property damage resulting from my presence on the Districts’ properties.

When returning this application, a copy of your driver’s license and a copy of your registration f or the upcoming year will be needed.
